Terms and Conditions (T&C’s) for Communication through WhatsApp Messenger

By Opting-in/ accepting the terms and conditions, you (the “User”) give consent to NeoGrowth Credit Private Limited (NeoGrowth/ We/ Us) and its partners/Service Providers to communicate with you on WhatsApp for all its transactional and promotional messages/ communication needs (“WhatsApp/ Service/ Facility”). We will store your details responsibly and use it to enrich your experience with Us.

You are subscribing to the WhatsApp/ Service/ Facility and participating in engaging with us using WhatsApp channel. Subscribing to the WhatsApp/ Service/ Facility will be taken as your explicit consent to receive communication from Us on WhatsApp. You are required to subscribe to the WhatsApp Service by sending a SMS ‘Hi’ to +91 8655744391; 8655744392; 8655744393

You can unsubscribe to the WhatsApp/ Service/ Facility at any time by sending ‘STOP’ to our official WhatsApp number post which any messages will not be sent. This unsubscription will be applicable for all linked accounts which have the same registered mobile number.

You should not share any personal identification/account related sensitive personal information such as account number, password, PIN, OTP, etc. on the WhatsApp/ Service/ Facility.

Subscription obtained will be deemed applicable for all linked accounts which have the same mobile number registered with us.

6.

By subscribing to the Service, customers explicitly consent to receiving communications from NeoGrowth Credit Pvt Ltd via WhatsApp.

7.

By subscribing to the WhatsApp Service/Facility, You agrees that NeoGrowth may share the Yours’s registered mobile number and name, as recorded in NeoGrowth official records, with WhatsApp.

8.

You may continue to receive SMS and email alerts for selected communications.

9.

If your phone or device is lost or stolen and you wish to stop receiving WhatsApp messages on that device, you must send the keyword 'STOP' to us on the official WhatsApp profile.

10.

If your phone or device is lost or stolen and you want to stop receiving WhatsApp messages on that device, customers must promptly unsubscribe from the Service by visiting the link helpdesk@neogrowth.in provided and following the instructions provided there.

11.

You are responsible for ensuring a suitable network connection on their device or mobile phone when accessing the Service. The receipt of messages by Customers depends on this network connection. NeoGrowth Credit Pvt Ltd. cannot be held accountable for any delays or failures in receiving responses due to device compatibility issues, internet plans, inadequate network coverage from service providers, or any other reasons.

12.

Users who have subscribed to WhatsApp Service/Facility are advised to uninstall WhatsApp when switching to a new device.

13.

You are prohibited from submitting or transmitting any content through the WhatsApp Service/Facility that is unethical and/or immoral.

14.

The User agrees without conditions and irrevocably to the following:

  • That all the WhatsApp/ Service/ Facility provided are subject to applicable law and the rules, regulations, notifications, circulars and guidelines introduced or amended from time to time by the RBI and/or any regulatory/ statutory/ governmental authority.
  • That the User shall provide us with such information and/or assistance as is required for the performance of the WhatsApp/ Service/ Facility.
  • The User agrees not to submit or transmit any content through the WhatsApp Service/Facility that includes:
  • not to submit or transmit any content through the WhatsApp Service/Facility that is obscene, vulgar, pornographic, immoral, illegal, illicit, unethical, antisocial, or encourages the commission of a crime or violation of any law. Furthermore, content shall not violate any laws in India or the jurisdiction where the User resides, nor infringe upon the intellectual property rights of a third party.
  • 15.

    The User acknowledges that using the WhatsApp application may entail additional risks and may not be completely secure. Any messages and information exchanged are vulnerable to being read, intercepted, interrupted, or manipulated by third parties, or may experience delays in transmission. We disclaim responsibility or liability to the User or any third party for any consequences arising from fraud or impersonation incidents involving the WhatsApp application.

    16.

    The User is responsible for maintaining the security and safeguarding of his account on WhatsApp application as well as the registered mobile number and linked device (s).

    17.

    The User acknowledges and agrees unconditionally and irrevocably to the following responsibilities:

  • Maintain strict confidentiality of device passwords and refrain from disclosing them to any other person under any circumstances.
  • Memorize passwords without recording them in written or electronic form.
  • Prevent unauthorized access to the device and avoid leaving it unattended while using WhatsApp.
  • Implement a passcode, password, PIN, or similar security measure to lock and restrict access to the device, ensuring it is not shared with others.
  • Adhere to restrictions imposed by the device provider.
  • Take necessary precautions against ransomware, malware, viruses, and other security threats by installing adequate antivirus protection.
  • Assume sole responsibility for protecting and securely storing the SIM card, device, installed applications (specifically WhatsApp), login IDs, User Information, security details, and passwords mentioned above.
  • Acknowledge that NeoGrowth Credit Pvt ltd bears no liability for any direct, indirect, consequential, or other losses resulting from compromised security measures.
  • 18.

    The User agrees that any information provided on WhatsApp, upon request, is extracted from NeoGrowth’s computerized backup system, which may not be continuously updated in real time. We will provide the information as last updated in its systems. While we will make reasonable efforts to ensure the accuracy of the information, it cannot be held liable for any errors or losses resulting from the User's reliance on such information or actions taken based on it.

    19.

    NeoGrowth does not guarantee that the WhatsApp Service/Facility will be available uninterrupted at all times. We are not liable for any changes, limitations, or interruptions in the terms of use or operation of the WhatsApp application, or for any inability of the User to use mobile applications.

    20.

    NeoGrowth its agents, affiliated companies, officers, directors, employees, and contractors shall not be liable under any circumstances for any direct, indirect, punitive, incidental, special, or consequential damages arising from the use of, or inability to use, the WhatsApp Service/Facility, or due to the unavailability of the WhatsApp Service/Facility for reasons beyond our control. This includes any responses provided by the program running in the backend.

    21.

    WhatsApp and the Facebook family of companies may utilize this information to operate, enhance, understand, customize, support, and market their business products and consumer services, in accordance with the terms and conditions you accepted when using the WhatsApp Messenger facility on your device.

    22.

    These terms and conditions are supplementary to any other terms and conditions set forth by NeoGrowth from time to time, including those on its website https://neogrowth.in/ or mobile application. These additional terms may relate to accounts or other products, services, facilities, or offers provided by us.

    23.

    We will continue to send messages and alerts to the User's device even if the SIM card associated with the registered mobile number has been removed, as the phone number remains registered for the WhatsApp Service/Facility. It is the User's responsibility to ensure that WhatsApp is installed on the mobile phone or device using the registered mobile number to receive our WhatsApp messages accurately.

    24.

    We reserve our right, at any time and at its discretion and without prior notice or providing reasons, to add, alter, modify, change, or vary any or all of these terms and conditions, or to entirely replace them.

    25.

    These terms and conditions, and/or the use of the WhatsApp Service/Facility provided through WhatsApp, shall be governed by the laws of the Republic of India. The User agrees to submit exclusively to the jurisdiction of the courts located in Mumbai, India, regarding any claims or matters arising under these terms and conditions. We bears no responsibility, direct or indirect, for non-compliance with the laws of any country other than the Republic of India. Accessing the WhatsApp Service/Facility via the internet from a country other than India does not imply that the laws of that country govern these terms and conditions and/or the use of the WhatsApp Service/Facility.

    26.

    We reserve the right to withdraw or replace this Service at any time, without prior notice and without providing any reasons. Further, we also reserve the right, at its sole discretion and without prior notice or intimation, to add, alter, modify, change, or vary any or all of these terms and conditions, or to entirely replace them.

    27.

    Participation in this Service is entirely optional. By choosing to use this Service, you agree to abide by the terms and conditions outlined herein. Your use of the Service constitutes your acknowledgment, understanding, and unconditional acceptance of these terms and conditions without any additional action required.
